Terms
Terms of service
These terms govern access to Digisite, the portal operated by Digiscript Philippines Inc. through which our clients view site monitoring footage. They apply to every person who signs in and to every recipient of a share link. They cover the software only: what is captured, how often, and at what price is set by the services agreement between Digiscript and the client organisation, and where the two documents differ on those points, the services agreement prevails.
1. Accounts
Digisite accounts are created by Digiscript at the request of a client organisation. There is no public sign-up, and no one can add themselves or a colleague to an organisation. An account belongs to one named person and is not to be shared; where several people need access, the organisation asks us for several accounts. You are responsible for keeping your password confidential and for telling us promptly if you believe someone else has used it.
A client organisation may ask us at any time to change what an account can open, or to deactivate it. Deactivation stops the login working but preserves the account and its history, because removing the record of who had access would defeat the point of keeping one.
2. What Digisite provides
Digisite presents the footage Digiscript has captured for your organisation, organised by project, source and capture date, together with tools to compare dates, download files where permitted, and share a defined part of the record with a named recipient. It is a viewing record. It is not a safety system, a security monitoring service, a survey instrument of record, or a substitute for site inspection, and it must not be relied on for any of those purposes.
Coverage gaps are displayed as gaps. Where a capture range is inferred rather than recorded, it is labelled as estimated. We present the record as it is, and we ask that any figure taken from the portal into a report, claim or certification be checked against the underlying files first.
3. Acceptable use
You agree not to:
- attempt to reach any organisation, project or file your account has not been given;
- probe, scan or test the security of the service, or interfere with its normal operation;
- use automated tools to retrieve footage in bulk outside the download features provided;
- remove or obscure any notice of ownership, or present Digiscript footage as another party’s work;
- upload or transmit anything unlawful, or use the support thread to send material unrelated to the monitoring service.
4. Share links
A share link gives a named part of the record to somebody without an account. Anyone holding the link can open what it covers, subject to any passcode and expiry set when it was created. The person who creates a link is responsible for who receives it. Links can be revoked at any time and revocation takes effect immediately, but it cannot recall material that has already been downloaded.
5. Ownership
Footage of a client’s site belongs to that client, subject to the payment terms of the services agreement covering its capture. The Digisite platform — its software, interfaces, processing pipelines, derived indexes and documentation — belongs to Digiscript, and nothing in these terms transfers any part of it. Access to the portal is a licence to use it for the client’s own project purposes, and it ends when the account does.
6. Availability
We aim to keep Digisite available at all times and to give notice before planned maintenance, but we do not commit to a service level in these terms. The portal depends on third-party cloud storage, video delivery and authentication providers, and an outage at one of them will be visible here. Loss of access to the portal does not affect the client’s ownership of its footage, and we will supply a copy of any file on written request.
7. Suspension
We may suspend an account without notice where we have reasonable grounds to believe it has been compromised or is being used in breach of section 3, and we will tell the client organisation why. Access ends when the services agreement ends; the client may request a copy of its footage before that date.
8. Liability
To the extent permitted by Philippine law, Digiscript is not liable for indirect or consequential loss, for loss of profit or opportunity, or for any decision taken on the basis of footage viewed in the portal without independent verification. Our total liability arising out of the portal is limited to the fees paid by the client organisation for the monitoring service in the twelve months preceding the claim. Nothing in these terms excludes liability for fraud, for gross negligence, or for any liability that cannot lawfully be excluded.
9. Changes
We will post any material change to these terms on this page with a new version number, and tell account holders by email at least fifteen days before it takes effect. Continuing to sign in after that date means the revised terms apply.
10. Governing law
These terms are governed by the laws of the Republic of the Philippines. The parties submit to the exclusive jurisdiction of the proper courts of Pasig City, Metro Manila, without prejudice to either party seeking urgent relief elsewhere. If any provision is held unenforceable, the rest remains in force.
